Objectives of the Course Explaining the legal and theoretical principles and concepts of ADR.
Evaluating the factors driving the global growth of ADR and its relationship with litigation across jurisdictions.
Demonstrating effective communication and practical problem-solving in complex ADR scenarios.
Applying regulatory frameworks and legal principles to core ADR processes, including emerging professional and online ADR.
Course Content The main concepts of the law and theory underpinning Alternative Dispute Resolution (ADR), ADR’s relationship with litigation, and the legal and regulatory framework within which each ADR process operates. Students need to be familiar with these alternative processes, such as arbitration and mediation, and the benefits and risks they present. At the same time, these alternative processes require creative and interdisciplinary problem-solving perspectives and skills.
